Tux-Support.com Terms of Service
1. Service Availability and Bandwidth
While we strive to provide dedicated bandwidth as advertised, there may be circumstances beyond our control that affect service availability and performance. These include, but are not limited to, issues with third-party ISPs, network disruptions, or other technical limitations. Tux-Support.com is not liable for any disruptions or limitations in service due to such factors.
2. Acceptable Use Policy
You agree not to use our services for any unlawful or prohibited activities, including but not limited to:
Hosting or distributing illegal content such as pirated software, hate speech, or pornography.
Engaging in activities that harm the network or other users, such as DDoS attacks, spreading malware, or hacking.
Using our services to infringe on the intellectual property rights of others.
3. Copyright and Licensing
It is the sole responsibility of the streamer to obtain all necessary licenses and comply with applicable copyright laws. Tux-Support.com is not liable for any copyright infringements or legal violations by the streamer. The streamer agrees to indemnify and hold Tux-Support.com harmless from any claims, damages, or legal actions arising from the misuse or unauthorized use of copyrighted content.
4. Data Privacy
Tux-Support.com will only share customer data and information with authorized Tux-Support.com staff as necessary to provide services. We guarantee that customer data will never be sold to third parties.
5. Payment Terms and Account Suspension
Payment for services is due within 30 days of the invoice date. Failure to make payment within this period will result in the suspension of the account. Once an account is suspended, the IP addresses and port numbers associated with that account may be reassigned to other customers and will not be recoverable by the original account holder. Customers may be subject to late fees, if applicable, and must submit a ticket to request reactivation or changes to their account.
6. Limitation of Liability
Tux-Support.com shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use the services, including but not limited to loss of data, profits, or business interruption, even if Tux-Support.com has been advised of the possibility of such damages.
7. Service Level Agreement (SLA)
We strive to maintain a high level of service availability. However, we do not guarantee 100% uptime. If service levels fall below the agreed-upon levels, customers may be eligible for service credits as outlined in the SLA, which is available upon request.
8. Termination of Service
Either party may terminate the service agreement for any reason, with a notice period of 30 days. Upon termination, the customer’s data will be retained for a period of 30 days, after which it will be permanently deleted. Tux-Support.com reserves the right to terminate service immediately in case of a violation of the Acceptable Use Policy or non-payment.
9. Backup and Data Retention Policy
While Tux-Support.com performs regular backups of its systems, it is the customer’s responsibility to maintain their own backups of all data hosted on our services. We do not guarantee the availability of backups, and customers should not rely solely on our backup services.
10. Support and Maintenance
Tux-Support.com provides customer support through our ticketing system. Support is available 24/7, with response times varying depending on the severity of the issue. Scheduled maintenance will be announced in advance, and while we strive to minimize downtime, some interruptions may be necessary.
11. Governing Law and Jurisdiction
These Terms of Service shall be governed by and construed in accordance with the laws of Tennessee. Any disputes arising from or relating to these terms shall be resolved in the courts of Tennessee.
12. Amendments to Terms
Tux-Support.com reserves the right to amend these Terms of Service at any time. Customers will be notified of any significant changes via email or through our website. Continued use of the service after such changes constitutes acceptance of the new terms.
13. Dispute Resolution
In the event of a dispute, both parties agree to first attempt to resolve the issue through informal negotiation. If the dispute cannot be resolved informally, it shall be submitted to binding arbitration under the rules of Tennessee Mediators before resorting to litigation.
14. User Responsibilities
Customers are responsible for maintaining the security of their account credentials, ensuring the accuracy of the information provided during registration, and complying with all applicable laws while using our services.
15. Intellectual Property Rights
All intellectual property rights in the services provided by Tux-Support.com, including but not limited to software, trademarks, and content, remain the property of Tux-Support.com. Customers retain ownership of any content they upload or create using our services.
16. Force Majeure
Tux-Support.com shall not be liable for any failure to perform its obligations under these terms due to causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, labor disputes, or governmental actions.
